These Terms and Conditions ("Terms") govern your use of the Keystone Trade Marketing website located at https://www.keystonetrademarketing.com and your engagement of our services. By accessing our website or purchasing our services, you agree to be bound by these Terms. Please read them carefully.
Keystone Trade Marketing provides digital marketing services for contractors and skilled trades businesses in Hawaii, including but not limited to website design and development, search engine optimization (SEO), Google Business Profile management, lead generation, and ongoing marketing support ("Services").
The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate Service Agreement or Statement of Work provided to you prior to commencement of services.
One-Time Site Builds: Payment is due in full prior to project commencement unless otherwise agreed in writing. All payments are processed securely through Stripe.
Monthly Plans: Subscription fees are billed monthly on the anniversary of your start date. Month-to-month plans may be cancelled at any time with no penalty. Plans with a 6-month minimum commitment may be cancelled after the commitment period has been fulfilled.
All fees are stated in U.S. dollars. You are responsible for any applicable taxes. Failure to pay may result in suspension or termination of services.
Site Builds: Due to the custom nature of website design and development, all one-time payments are non-refundable once work has commenced. If you cancel before work begins, a full refund will be issued.
Monthly Plans: Monthly subscription fees are non-refundable for the current billing period. You will retain access to all services through the end of your paid period.

Delays caused by failure to meet these responsibilities may affect project timelines and are not the liability of Keystone Trade Marketing.
Your Content: You retain ownership of all content, logos, images, and materials you provide to us. By providing such materials, you grant us a license to use them solely for the purpose of delivering your services.
Deliverables: Upon receipt of full payment, you will own the final website and all custom content created specifically for your project. We retain the right to display your project in our portfolio and marketing materials unless you request otherwise in writing.
Third-Party Tools: Certain components of your website may rely on third-party themes, plugins, or platforms subject to their own licensing terms.
Keystone Trade Marketing maintains an exclusivity policy of working with one contractor per trade per island. This means we will not onboard a direct competitor in the same trade and geographic market as an existing active client. This exclusivity is maintained for the duration of your active service agreement.
Keystone Trade Marketing provides digital marketing services and makes no guarantees regarding specific rankings, lead volumes, revenue outcomes, or advertising performance. Results vary based on market conditions, competition, budget, and other factors outside our control.
To the maximum extent permitted by law, Keystone Trade Marketing's total liability for any claim arising from or related to our services shall not exceed the total fees paid by you in the three (3) months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or business opportunities.
Either party may terminate a service agreement with written notice as specified in the applicable Service Agreement. Upon termination, you will retain ownership of all paid deliverables. We reserve the right to terminate services immediately if you violate these Terms or engage in conduct that we deem harmful to our business or other clients.
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement, including business strategies, client lists, and pricing. This obligation survives termination of the service agreement.
These Terms are governed by the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Honolulu County, Hawaii.
We reserve the right to update these Terms at any time. We will post the revised Terms on this page with an updated effective date. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.
